These Terms & Conditions ("Terms") govern your access to and use of RollDay at rollday.io and related applications and services (the "Services"), including our SMS / text messaging program (the "Campaign"). By using the Services or providing a mobile number for texts, you agree to these Terms.
1. Who we are
RollDay provides field-service scheduling, dispatch, and related software for contractors and the customers they serve. References to "RollDay," "we," "us," or "our" mean the RollDay service operated at rollday.io.
2. Accounts and acceptable use
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. You may not misuse the Services, attempt unauthorized access, interfere with other users, or use the Services in violation of law or these Terms.
If you use RollDay on behalf of a business, you represent that you have authority to bind that business to these Terms, and that "you" includes that business.
3. SMS Campaign terms & conditions
RollDay (and contractor businesses using RollDay) may send transactional, service-related text messages to mobile numbers provided for that purpose. Typical messages include job assignment / appointment confirmations and technician "on the way" updates.
Consent: By providing a mobile number in connection with a service request, estimate, booking, or customer profile in RollDay, you consent to receive SMS messages about that service relationship. Consent is not a condition of purchase.
Message frequency varies. You may receive messages when a job is scheduled or updated, when a technician is assigned, when a technician is on the way, and for related service notices. Frequency depends on your service activity with the business.
Message and data rates may apply.
Supported carriers may vary. Delivery is subject to your mobile carrier's network. Carriers are not liable for delayed or undelivered messages.
Opt out: Reply STOP to any RollDay SMS to cancel. You will receive a confirmation, and we will stop further SMS to that number except as needed to confirm the opt-out or as required by law. Reply HELP for help, or email privacy@rollday.io.
We do not sell, rent, or share mobile phone numbers with third parties or affiliates for their marketing or promotional purposes. Mobile numbers are used to deliver the Campaign messages described here and to operate and support the Services (including through our SMS providers). See our Privacy Policy for more detail.
4. Contractor customer data
When a contractor organization uses RollDay, that organization controls the customer and job information it enters (including phone numbers). RollDay processes that information to provide the Services. Organizations are responsible for having a lawful basis and appropriate notices/consents to contact their customers, including by SMS.
5. Subscriptions and billing
Paid plans are billed through our payment processor. Fees, trials, and plan features are described at checkout and on our pricing pages. Except where required by law or expressly stated otherwise, fees are non-refundable.
6. Intellectual property
The Services, including software, branding, and content we provide, are owned by RollDay or our licensors. You receive a limited, non-exclusive, non-transferable right to use the Services as permitted by your plan. You retain ownership of data you submit; you grant us a license to host and process it to operate the Services.
7. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROLLDAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES OR SMS DELIVERY WILL BE UNINTERRUPTED, ERROR-FREE, OR TIMELY.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROLLDAY AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICES OR SMS CAMPAIGN. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
9. Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if needed to protect the Services or others. Provisions that by their nature should survive termination will survive.
10. Changes
We may update these Terms by posting a revised version on this page and updating the "Last updated" date. Continued use after changes become effective constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules, except where mandatory local law applies.
